Privacy policy
  • About the Website
    • Welcome to www.ehsod.com (Website). The Website facilitates interactions between:
      • parties providing services (Provider); and
      • parties receiving services (Receiver),

      making it easier for the Receiver and the Provider to locate, communicate, arrange payment and deliver the services in a fast and secure manner (Services).

    • The Website is operated by Brogan Investments Pty Ltd (ACN 624 640 311). Access to and use of the Website, or any of its associated products or Services, is provided by Brogan Investments Pty Ltd. Please read these terms and conditions (Terms) carefully. By using, browsing and/or reading the Website, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of its products or Services, immediately.
    • Brogan Investments Pty Ltd reserves the right to review and change any of the Terms by updating this page at its sole discretion. When Brogan Investments Pty Ltd updates the Terms, it will use reasonable endeavours to provide you with notice of updates of the Terms. Any changes to the Terms take immediate effect from the date of their publication. Before you continue, we recommend you keep a copy of the Terms for your records.
  • Acceptance of the Terms
    • You accept the Terms by registering for the Services and/or making any payment as required under the Terms for use of the Services. You may also accept the Terms by clicking to accept or agree to the Terms where and if this option is made available to you by Brogan Investments Pty Ltd in the user interface.
  • The Services
    • In order to access the Services, both the Receiver and the Provider are required to register for an account through the Website (Account).
    • As part of the registration process, or as part of your continued use of the Services, you may be required to provide personal information about yourself (such as identification or contact details), including:
      • Email address
      • Preferred username
      • Telephone number
      • Password
      • Any other information relevant to job applications, including but not limited to phone number, education and work experience
    • You warrant that any information you give to Brogan Investments Pty Ltd in the course of completing the registration process will always be accurate, correct and up to date.
    • Once you have completed the registration process, you will be a registered member of the Website (Member) and agree to be bound by the Terms.
    • You may not use the Services and may not accept the Terms if:
      • you are not of legal age to form a binding contract with Brogan Investments Pty Ltd;
        or
      • you are a person barred from receiving the Services under the laws of Australia or
        other countries including the country in which you are resident or from which you
        use the Services.
  • Your obligations as a Member
      • As a Member, you agree to comply with the following:
    • you will not share your profile with any other person;
    • you will use the Services only for purposes that are permitted by:
      • the Terms; and
      • any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions;
    • you have sole responsibility for protecting the confidentiality of your password and/or email address. Use of your password by any other person may result in the immediate cancellation of the Services;
    • any use of your registration information by any other person, or third parties, is strictly prohibited. You agree to immediately notify Brogan Investments Pty Ltd of any unauthorised use of your password or email address or any breach of security of which you have become aware;
    • you must not expressly or impliedly impersonate another Member or use the profile or password of another Member at any time;
    • any content that you broadcast, publish, upload, transmit, post or distribute on the Website (Your Content) will always be accurate, correct and up to date and you will maintain reasonable records of Your Content.
    • you agree not to harass, impersonate, stalk, threaten another Member of the Website (where interaction with other Members is made available to you);
    • access and use of the Website is limited, non-transferable and allows for the sole use of the Website by you for the purposes of providing the Services;
    • you will not use the Services or the Website in connection with any commercial endeavours except those that are specifically endorsed or approved by the management of Brogan Investments Pty Ltd;
    • you will not use the Services or Website for any illegal and/or unauthorised use which includes collecting email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorised framing of or linking to the Website;
    • you agree that commercial advertisements, affiliate links and other forms of solicitation may be removed from Member profiles without notice and may result in termination of the Services. Appropriate legal action will be taken by Brogan Investments Pty Ltd for any illegal or unauthorised use of the Website; and
    • you acknowledge and agree that any automated use of the Website or its Services is prohibited.
    • you acknowledge and agree that reserves the right to monitor, moderate, or remove any content posted on the Website that violates these Terms or is otherwise deemed inappropriate in ‘s sole discretion.
    • you agree to use the Website and its Services only for lawful purposes and in accordance with these Terms, and you will not engage in any activity that interferes with or disrupts the Website or its Services.
  • Using the Website as the Receiver
    • EHS On Demand is a dynamic two-sided marketplace designed to connect employers with qualified Environmental, Health, and Safety (EHS) professionals efficiently. As a receiver of services, it is your responsibility to accurately define project requirements, evaluate provider capabilities, and ensure clear engagement terms. By using the EHS On Demand platform, you are expected to actively manage the sourcing and collaboration process, uphold fair and timely communication, and maintain a commitment to compliance, safety, and environmental standards. The platform enables you to enhance your organization’s EHS outcomes by leveraging trusted expertise—but its success relies on your active participation and accountability.
  • Using the Website as the Provider
    • EHS On Demand is a two-sided marketplace that enables Environmental, Health, and Safety (EHS) professionals (“Providers”) to connect with employers seeking EHS services. Providers are responsible for creating accurate profiles, uploading relevant certifications, and managing their availability. Once verified, Providers may apply for or be matched with projects based on their expertise. Engagements are agreed upon between the Provider and Employer, including scope, rate, and timeline. Providers must deliver services professionally and in accordance with agreed terms. Payments are processed securely through the platform, and Providers may be reviewed upon completion of work.
  • Payment
    • By Brogan Investments Pty Ltd offering the Services to you, you agree that:
      EHS On Demand offers a freemium model that provides employers with basic access to browse and connect with EHS professionals. When service requirements expand beyond the standard freemium offering—such as for premium support, project management, verified provider sourcing, or tailored compliance solutions—EHS On Demand will issue a formal quote and service agreement. This quote outlines the scope of work, associated fees, and payment terms. Upon acceptance, a contract will be executed between the employer and EHS On Demand, and services will commence as agreed. All payments must be made in accordance with the terms specified in the contract, and may be processed through secure payment channels.
    • All payments made in the course of your use of the Services are made using Paypal. In using the Website, the Services or when making any payment in relation to your use of the Services, you warrant that you have read, understood and agree to be bound by the Paypal terms and conditions which are available on their website.
  • Refund Policy
    • All Providers agree to comply with the Australian Consumer Law. Any benefits set out in this Policy may apply in addition to consumer’s rights under the Australian Consumer Law.
    • Since Brogan Investments Pty Ltd is only a facilitator in introducing the Receiver to the Provider and providing a system to make safe payment, Brogan Investments Pty Ltd does not hold any liability to the Receiver directly and will not personally refund them any payments made in the use of Services.
    • Notwithstanding the above clause, if a Receiver is unsatisfied with the services provided by the Provider or believes that they may be entitled to a refund, then Brogan Investments Pty Ltd requires the Receiver to:
      • contact the Provider directly to request a refund; and
      • if contacting the Provider is not successful after fourteen (14) days, contact Brogan Investments Pty Ltd through the ‘Contact Us’ section of the Website outlining why you believe you are entitled to a refund so we are able to determine if the Provider should be removed from the Services.
    • If contacted by a Receiver who is requesting a refund pursuant to the above clause, the
      Provider agrees that it will immediately:

      • complete the Brogan Investments Pty Ltd refund request form (Request Form) provided at www.ehsod.com; and
      • provide both the Request Form and the email from the Receiver requesting the refund to Brogan Investments Pty Ltd.
      • provide a detailed explanation of the circumstances leading to the refund request, including any relevant documentation or evidence to support the claim.
    • If the Provider agrees to a refund it is acknowledged that the Provider will instruct Brogan Investments Pty Ltd to refund all or part of the payments made to the Receiver directly, less any fees and charges incurred by Brogan Investments Pty Ltd in processing the refund.
    • Both the Receiver and Provider agree that they will comply with the Refund Policy contained in this clause of these Terms.
  • Copyright and Intellectual Property
    • The Website, the Services and all of the related products of Brogan Investments Pty Ltd are subject to copyright. The material on the Website is protected by copyright under the laws of Australia and through international treaties. Unless otherwise indicated, all rights (including copyright) in the Services and compilation of the Website (including but not limited to text, graphics, logos, button icons, video images, audio clips, Website code, scripts, design elements and interactive features) or the Services are owned or controlled for these purposes, and are reserved by Brogan Investments Pty Ltd or its contributors.
    • All trademarks, service marks and trade names are owned, registered and/or licensed by Brogan Investments Pty Ltd, who grants to you a worldwide, non-exclusive, royalty-free, revocable license whilst you are a Member to:
      • use the Website pursuant to the Terms;
      • copy and store the Website and the material contained in the Website in your device’s cache memory; and
      • print pages from the Website for your own personal and non-commercial use.

      Brogan Investments Pty Ltd does not grant you any other rights whatsoever in relation to the Website or the Services. All other rights are expressly reserved by Brogan Investments
      Pty Ltd.

    • Brogan Investments Pty Ltd retains all rights, title and interest in and to the Website and all related Services. Nothing you do on or in relation to the Website will transfer any:
      • business name, trading name, domain name, trade mark, industrial design, patent, registered design or copyright, or
      • a right to use or exploit a business name, trading name, domain name, trade mark or industrial design, or
      • a thing, system or process that is the subject of a patent, registered design or copyright (or an adaptation or modification of such a thing, system or process), to you.
    • You may not, without the prior written permission of Brogan Investments Pty Ltd and the permission of any other relevant rights owners: broadcast, republish, up-load to a third party, transmit, post, distribute, show or play in public, adapt or change in any way the Services or third party Services for any purpose, unless otherwise provided by these Terms. This prohibition does not extend to materials on the Website, which are freely available for re-use or are in the public domain.
    • Where you broadcast, publish, upload, transmit, post or distribute Your Content on the Website, then you grant to Brogan Investments Pty Ltd a non-exclusive, transferrable, perpetual, royalty-free, irrevocable, worldwide licence to broadcast, republish, up-load to a third party, transmit, post, distribute, show or play in public, adapt or change Your Content.
    • You warrant that Your Content does not infringe upon the intellectual property rights, privacy rights, publicity rights, or other legal rights of any third party, and you agree to indemnify and hold harmless from any claims arising from such infringement.
  • Privacy
    • Brogan Investments Pty Ltd takes your privacy seriously and any information provided through your use of the Website and/or Services are subject to Brogan Investments Pty Ltd’s Privacy Policy, which is available on the Website.
  • General Disclaimer
    • Nothing in the Terms limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the Australian Consumer Law (or any liability under them) which by law may not be limited or excluded.
    • Subject to this clause, and to the extent permitted by law:
      • all terms, guarantees, warranties, representations or conditions which are not expressly stated in the Terms are excluded; and
      • Brogan Investments Pty Ltd will not be liable for any special, indirect or consequential loss or damage (unless such loss or damage is reasonably foreseeable resulting from our failure to meet an applicable Consumer Guarantee), loss of profit or opportunity, or damage to goodwill arising out of or in connection with the Services or these Terms (including as a result of not being able to use the Services or the late supply of the Services), whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise.
    • Use of the Website and the Services is at your own risk. Everything on the Website and the Services is provided to you “as is” and “as available” without warranty or condition of any kind. None of the affiliates, directors, officers, employees, agents, contributors and licensors of Brogan Investments Pty Ltd make any express or implied representation or warranty about the Services or any products or Services (including the products or Services of Brogan Investments Pty Ltd) referred to on the Website. This includes (but is not restricted to) loss or damage you might suffer as a result of any of the following:
      • failure of performance, error, omission, interruption, deletion, defect, failure to correct defects, delay in operation or transmission, computer virus or other harmful component, loss of data, communication line failure, unlawful third party conduct, or theft, destruction, alteration or unauthorised access to records;
      • the accuracy, suitability or currency of any information on the Website, the Services, or any of its Services related products (including third party material and advertisements on the Website);
      • costs incurred as a result of you using the Website, the Services or any of the products of Brogan Investments Pty Ltd; and
      • the Services or operation in respect to links which are provided for your convenience.
    • You acknowledge that Brogan Investments Pty Ltd Website and the Services are only intended to facilitate the interactions between the Receiver and the Provider and does not offer any services other than the Services and Brogan Investments Pty Ltd holds no liability to you as a result of any conduct of the Members or the misuse of Your Content by any party (including other Members).
  • Competitors
    • If you are in the business of providing similar Services for the purpose of providing them to users for a commercial gain, whether business users or domestic users, then you are a competitor of Brogan Investments Pty Ltd. Competitors are not permitted to use or access any information or content on our Application. If you breach this provision, Brogan Investments Pty Ltd will hold you fully responsible for any loss that we may sustain and hold you accountable for all profits that you might make from such a breach.
  • Limitation of Liability
    • Brogan Investments Pty Ltd’s total liability arising out of or in connection with the Services or these Terms, however arising, including under contract, tort (including negligence), in equity, under statute or otherwise, will not exceed the resupply of the Services to you.
    • You expressly understand and agree that Brogan Investments Pty Ltd, its affiliates, employees, agents, contributors and licensors shall not be liable to you for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. This shall include, but is not limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation and any other intangible loss.
    • You acknowledge and agree that Brogan Investments Pty Ltd holds no liability for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you as a result of providing Your Content to the Website.
  • Termination of Contract
    • If you want to terminate the Terms, you may do so by providing Brogan Investments Pty Ltd with 14 days’ notice of your intention to terminate by sending notice of your intention to terminate to Brogan Investments Pty Ltd via the ‘Contact Us’ link on our homepage.
    • Brogan Investments Pty Ltd may at any time, terminate the Terms with you if:
      • you have breached any provision of the Terms or intend to breach any provision;
      • Brogan Investments Pty Ltd is required to do so by law;
      • Brogan Investments Pty Ltd is transitioning to no longer providing the Services to Members in the country in which you are resident or from which you use the service; or
      • the provision of the Services to you by Brogan Investments Pty Ltd is, in the opinion of Brogan Investments Pty Ltd, no longer commercially viable.
      • the user has engaged in repeated violations of these Terms or has been the subject of multiple complaints from other users or third parties.
    • Subject to local applicable laws, Brogan Investments Pty Ltd reserves the right to discontinue or cancel your membership at any time and may suspend or deny, in its sole discretion, your access to all or any portion of the Website or the Services without notice if you breach any provision of the Terms or any applicable law or if your conduct impacts Brogan Investments Pty Ltd’s name or reputation or violates the rights of those of another party.
    • When the Terms come to an end, all of the legal rights, obligations and liabilities that you and Brogan Investments Pty Ltd have benefited from, been subject to (or which have accrued over time whilst the Terms have been in force) or which are expressed to continue indefinitely, shall be unaffected by this cessation, and the provisions of this clause shall continue to apply to such rights, obligations and liabilities indefinitely.
  • Indemnity
    • You agree to indemnify Brogan Investments Pty Ltd, its affiliates, employees, agents, contributors, third party content providers and licensors from and against:
      • all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with Your Content;
      • any direct or indirect consequences of you accessing, using or transacting on the Website or attempts to do so; and/or
      • any breach of the Terms.
  • Dispute Resolution
    1. Compulsory:
      • If a dispute arises out of or relates to the Terms, either party may not commence any Tribunal or Court proceedings in relation to the dispute, unless the following clauses have been complied with (except where urgent interlocutory relief is sought).
    2. Notice:
      • A party to the Terms claiming a dispute (Dispute) has arisen under the Terms, must give written notice to the other party detailing the nature of the dispute, the desired outcome and the action required to settle the Dispute.
    3. Resolution:
        On receipt of that notice (Notice) by that other party, the parties to the Terms (Parties) must:
      • Within 28 days of the Notice endeavour in good faith to resolve the Dispute expeditiously by negotiation or such other means upon which they may mutually agree;
      • If for any reason whatsoever, 28 days after the date of the Notice, the Dispute has not been resolved, the Parties must either agree upon selection of a mediator or request that an appropriate mediator be appointed by the EHS On Demand;
      • The Parties are equally liable for the fees and reasonable expenses of a mediator and the cost of the venue of the mediation and without limiting the foregoing undertake to pay any amounts requested by the mediator as a precondition to the mediation commencing. The Parties must each pay their own costs associated with the mediation
      • The mediation will be held in Sydney, Australia.
    4. Confidential:
      • All communications concerning negotiations made by the Parties arising out of and in connection with this dispute resolution clause are confidential and to the extent possible, must be treated as “without prejudice” negotiations for the purpose of applicable laws of evidence.
    5. Termination of Mediation:
      • If 2 months have elapsed after the start of a mediation of the Dispute and the Dispute has not been resolved, either Party may ask the mediator to terminate the mediation and the mediator must do so.
  • Venue and Jurisdiction
    • The Services offered by Brogan Investments Pty Ltd are intended to be used by residents of Australia. In the event of any dispute arising out of or in relation to the Website, you agree that the exclusive venue for resolving any dispute shall be in the courts of New South Wales, Australia.
  • Governing Law
    • The Terms are governed by the laws of New South Wales, Australia. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to the Terms and the rights created hereby shall be governed, interpreted and construed by, under and pursuant to the laws of New South Wales, Australia, without reference to conflict of law principles, notwithstanding mandatory rules. The validity of this governing law clause is not contested. The Terms shall be binding to the benefit of the parties hereto and their successors and assigns.
  • Severance
    • If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.

    • EHS On Demand respects your right to privacy and is committed to safeguarding the privacy of our customers and website visitors. This policy sets out how we collect and treat your personal information.
    • We adhere to the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) and to the extent applicable, the EU General Data Protection Regulation (GDPR).

    • EHS On Demand will, from time to time, receive and store personal information you submit to our website, provided to us directly or given to us in other forms.
    • You may provide basic information such as your name, phone number, address and email address to enable us to send you information, provide updates and process your product or service order.
    • We may collect additional information at other times, including but not limited to, when you provide feedback, when you provide information about your personal or business affairs, change your content or email preference, respond to surveys and/or promotions, provide financial or credit card information, or communicate with our customer support.
    • Additionally, we may also collect any other information you provide while interacting with us.
  • How we collect your personal information
    • EHS On Demand collects personal information from you in a variety of ways, including when you interact with us electronically or in person, when you access our website and when we engage in business activities with you. We may receive personal information from third parties. If we do, we will protect it as set out in this Privacy Policy.
    • By providing us with personal information, you consent to the supply of that information subject to the terms of this Privacy Policy.
  • How we use your personal information
    • EHS On Demand may use personal information collected from you to provide you with information about our products or services. We may also make you aware of new and additional products, services and opportunities available to you.
    • EHS On Demand will use personal information only for the purposes that you consent to.
      This may include to:

      • provide you with products and services during the usual course of our business activities;
      • administer our business activities;
      • manage, research and develop our products and services;
      • provide you with information about our products and services;
      • communicate with you by a variety of measures including, but not limited to, by telephone, email, sms or mail; and
      • investigate any complaints.

      If you withhold your personal information, it may not be possible for us to provide you with our products and services or for you to fully access our website.

    • We may disclose your personal information to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, legal proceedings or in response to a law enforcement agency request.
    • If there is a change of control in our business or a sale or transfer of business assets, we reserve the right to transfer to the extent permissible at law our user databases, together with any personal information and non-personal information contained in those databases.
  • Disclosure of your personal information
    • EHS On Demand may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes set out in this privacy policy.
    • If we do disclose your personal information to a third party, we will protect it in accordance with this privacy policy.
  • General Data Protection Regulation (GDPR) for the European Union (EU)
    • EHS On Demand will comply with the principles of data protection set out in the GDPR for the purpose of fairness, transparency and lawful data collection and use.
    • We process your personal information as a Processor and/or to the extent that we are a Controller as defined in the GDPR.
    • We must establish a lawful basis for processing your personal information. The legal basis for which we collect your personal information depends on the data that we collect
      and how we use it.
    • We will only collect your personal information with your express consent for a specific purpose and any data collected will be to the extent necessary and not excessive for its purpose. We will keep your data safe and secure.
    • We will also process your personal information if it is necessary for our legitimate interests, or to fulfil a contractual or legal obligation.
    • We process your personal information if it is necessary to protect your life or in a medical situation, it is necessary to carry out a public function, a task of public interest or if the function has a clear basis in law.
    • We do not collect or process any personal information from you that is considered “Sensitive Personal Information” under the GDPR, such as personal information relating to your sexual orientation or ethnic origin unless we have obtained your explicit consent, or if it is being collected subject to and in accordance with the GDPR.
    • You must not provide us with your personal information if you are under the age of 16 without the consent of your parent or someone who has parental authority for you. We do not knowingly collect or process the personal information of children.
  • Your rights under the GDPR

      personal information is obtained and used. EHS On Demand complies with your rights
      under the GDPR as to how your personal information is used and controlled if you are an
      individual residing in the EU
    • Except as otherwise provided in the GDPR, you have the following rights:
      • to be informed how your personal information is being used;
      • access your personal information (we will provide you with a free copy of it);
      • to correct your personal information if it is inaccurate or incomplete;
      • to delete your personal information (also known as “the right to be forgotten”);
      • to restrict processing of your personal information;
      • to retain and reuse your personal information for your own purposes;
      • to object to your personal information being used; and
      • to object against automated decision making and profiling.
    • Please contact us at any time to exercise your rights under the GDPR at the contact

    • We may ask you to verify your identity before acting on any of your requests.
  • Hosting and International Data Transfers
    • Information that we collect may from time to time be stored, processed in or transferred
      between parties or sites located in countries outside of Australia. These may include, but
      are not limited to Australia.
    • We and our other group companies have offices and/or facilities in Australia. Transfers to
      each of these countries will be protected by appropriate safeguards, these include one or more of the following: the use of standard data protection clauses adopted or approved by the European Commission which you can obtain from the European Commission Website; the use of binding corporate rules, a copy of which you can obtain from EHS On Demand’s Data Protection Officer.
    • The hosting facilities for our website are situated in Australia. Transfers to each of these Countries will be protected by appropriate safeguards, these include one or more of the following: the use of standard data protection clauses adopted or approved by the European Commission which you can obtain from the European Commission Website; the use of binding corporate rules, a copy of which you can obtain from EHS On Demand’s Data Protection Officer.
    • Our Suppliers and Contractors are situated in Australia. Transfers to each of these Countries will be protected by appropriate safeguards, these include one or more of the following: the use of standard data protection clauses adopted or approved by the European Commission which you can obtain from the European Commission Website; the use of binding corporate rules, a copy of which you can obtain from EHS On Demand’s Data Protection Officer.
    • You acknowledge that personal data that you submit for publication through our website or services may be available, via the internet, around the world. We cannot prevent the use (or misuse) of such personal data by others.
  • Security of your personal information
    • EHS On Demand is committed to ensuring that the information you provide to us is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure
      information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.
    • Where we employ data processors to process personal information on our behalf, we only do so on the basis that such data processors comply with the requirements under the GDPR and that have adequate technical measures in place to protect personal information against unauthorised use, loss and theft.
    • The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us, or receive from us.
